Res gestae covers statements or acts that form part of the same transaction and are admitted as evidence because they occur close in time to the event and are closely connected to it. The idea is that when something is happening, or happens immediately as it unfolds, what is said or done is part of what actually occurred and can be trusted more because of its spontaneity and immediacy. For example, a remark made at the scene during a confrontation, like someone shouting “He’s got a gun,” is treated as part of the event and may be admitted as evidence, since it is tied to the same incident and not a separate, later statement. Statements or events that are separate from the transaction, or that are merely documentary or relate to burden of proof, do not fit this rule.
